Terms of Service

1. Agreement to Terms

By accessing or using BookAndGo (the “Platform”), operated by NT Development Group Pty Ltd (“NT Development Group”, “we”, “us”, or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Platform. These Terms apply to all users of the Platform, including business owners (“Tenants”) and their end customers (“Clients”).

2. Description of Service

BookAndGo is a multi-tenant software-as-a-service (SaaS) booking platform designed for appointment-based service businesses. The Platform enables Tenants to manage bookings, clients, services, payments, and communications. Features include but are not limited to:

• Online appointment booking and calendar management
• Client management and communication tools
• AI-powered chat assistants for booking and enquiries
• SMS notifications and an AI-powered SMS bot
• Payment processing via Stripe Connect
• Invoicing, vouchers, reviews, and marketing campaigns
• A client-facing booking portal and business landing page

3. Account Registration

To use the Platform as a Tenant, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide truthful, current, and complete registration information
• Notify us immediately of any unauthorised use of your account
• Not share your account credentials with third parties
• Ensure that any individuals who access the Platform through your account comply with these Terms

We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription Plans & Billing

BookAndGo offers the following subscription tiers:

• Personal — Free. Limited to 1 provider, 30 bookings per month, and 30 clients.
• Starter — $29/month. Unlimited bookings, up to 200 clients, AI web chat, reviews, and reminders.
• Professional — $59/month. Up to 5 providers, SMS bot, vouchers, waitlist, campaigns, Stripe payments, and CSV import.
• Business — $99/month. Unlimited providers, full analytics, white-label options, and custom domain support.
• Enterprise — Custom pricing. Includes SLA, dedicated support, and custom integrations.

All paid subscriptions are billed monthly or annually via Stripe. Prices are in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. A 0.5% platform fee applies to all client payments processed through Stripe Connect on the Platform.

5. SMS Credits

Outbound SMS messages (confirmations, reminders, and bot responses) are billed using a prepaid credit system. SMS credit packs are available as follows:

• 50 credits for $25 AUD
• 100 credits for $40 AUD

SMS credits are non-refundable and do not expire. Credits are deducted per outbound message sent. An optional auto top-up feature is available to automatically purchase additional credits when your balance falls below a configurable threshold.

6. Free Trial

All paid subscription tiers include a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you may choose to subscribe to a paid plan or your account will revert to the Personal (free) tier. We reserve the right to modify or discontinue the free trial offer at any time.

7. Cancellation & Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access to your paid plan features until the end of your current billing period.
• Your account will revert to the Personal (free) tier after the billing period ends.
• Pro-rated refunds are not provided as a standard policy.
• In exceptional circumstances, refunds may be issued at NT Development Group's sole discretion.

SMS credits are non-refundable under any circumstances.

8. Acceptable Use

You agree not to use the Platform to:

• Offer, promote, or facilitate illegal services or activities
• Send spam, unsolicited messages, or bulk communications that violate applicable laws
• Abuse, manipulate, or exploit AI features (including chat bots and SMS bots) for purposes unrelated to legitimate booking and business enquiries
• Attempt to gain unauthorised access to other users' accounts or data
• Interfere with or disrupt the Platform's infrastructure or services
• Use the Platform in any manner that could damage, disable, or impair the service
• Violate any applicable local, state, national, or international law or regulation

We reserve the right to investigate and take appropriate action against any violations of this section, including suspending or terminating your account without notice.

9. AI Features Disclaimer

BookAndGo incorporates artificial intelligence features powered by Claude AI (Anthropic) to assist with booking enquiries, appointment scheduling, and general customer support via web chat and SMS. While we strive to provide helpful and accurate AI responses, AI-generated content is not guaranteed to be accurate, complete, or error-free. AI assistants may occasionally misinterpret queries, provide incorrect availability information, or generate unexpected responses. You acknowledge that AI features are provided on an “as is” basis, and NT Development Group accepts no liability for any loss or inconvenience arising from reliance on AI-generated responses.

10. Intellectual Property

The Platform, including its source code, design, branding, logos, and documentation, is the exclusive property of NT Development Group Pty Ltd and is protected by Australian and international intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the Platform without our prior written consent. The BookAndGo name and logo are trademarks of NT Development Group Pty Ltd.

11. Data Ownership & Privacy

You retain full ownership of all data you upload, enter, or generate through the Platform (“Your Data”). We do not claim any ownership rights over Your Data. We collect and process personal information in accordance with our Privacy Policy.

All data is hosted in Australia (Sydney, australia-southeast1) via Google Cloud Platform and Firebase. We implement appropriate technical and organisational measures to protect Your Data against unauthorised access, loss, or misuse. Upon account termination, you may request an export of Your Data within 30 days, after which it may be permanently deleted.

12. Limitation of Liability

To the maximum extent permitted by law, NT Development Group Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the Platform.

Our total aggregate liability to you for any claims arising from or related to these Terms or the Platform shall not exceed the total fees paid by you to NT Development Group in the twelve (12) months immediately preceding the event giving rise to the claim.

The Platform is provided on a best-effort basis. We do not guarantee any specific uptime or availability, except where a Service Level Agreement (SLA) has been separately agreed upon under an Enterprise plan.

13. Indemnification

You agree to indemnify, defend, and hold harmless NT Development Group Pty Ltd, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you at least 30 days in advance via the email address associated with your account. Your continued use of the Platform after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Platform and cancel your subscription before the changes take effect.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia. Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
